These Terms of Service ("Terms") are a legal agreement between you and Human Health Manual Pty Ltd ("we", "us", or "our") governing your access to and use of the web platform at openminerals.ai and related mobile applications (together, the "Services").
By creating an account, downloading the app, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.
The Services are intended for business and professional users. You must be at least 16 years old and capable of entering a binding contract. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You may create a personal account, join an existing organisation via invitation, or apply for site readiness onboarding through our web portal. Information you provide must be accurate and kept up to date.
Minesite provides AI-assisted tools for maintenance, inspection, procurement, and operational workflows. Features may vary by account type, subscription, organisation configuration, and platform (web or mobile). We may add, change, or discontinue features with reasonable notice where practicable.
AI-generated outputs are provided for informational and operational support only. You are responsible for reviewing outputs before relying on them for safety-critical, legal, financial, or engineering decisions.
New personal accounts may receive a limited free trial of mobile app features. Trial length, eligibility, and included features are shown in the app or at signup and may change from time to time. At the end of a trial, continued access may require an active subscription or organisation entitlement unless otherwise stated.
Some mobile features are offered as an auto-renewable subscription ("Minesite Pro" or similar name shown in the App Store). If you purchase a subscription:
Employees invited to an organisation account by their employer generally do not need a personal App Store subscription for organisation-provided access.
Certain web services (such as application review or onboarding fees) may be billed through Stripe or other payment providers. Fees, refund conditions, and deliverables are disclosed at checkout. Unless stated otherwise at purchase, review fees may be non-refundable once work has commenced.
Organisation or enterprise billing may be governed by a separate order form or master agreement. If there is a conflict between these Terms and a signed agreement with your organisation, the signed agreement prevails for that organisation.
You agree not to:
We may suspend or terminate access for conduct that violates these Terms or poses risk to the Services or other users.
You retain ownership of content and data you submit. You grant Minesite a worldwide, non-exclusive licence to host, process, display, and use that content solely to provide and improve the Services, support your organisation, and as described in our Privacy Policy.
You are responsible for ensuring you have appropriate rights and consents for data you upload, including workplace, customer, and personal information.
Minesite and its licensors own the Services, software, branding, and documentation. Except for the limited right to use the Services under these Terms, no rights are granted to you. Feedback you provide may be used by us without obligation.
The Services may integrate with third-party services (including Apple, Supabase, Stripe, and AI providers). Your use of those services may be subject to their terms. We are not responsible for third-party services outside our reasonable control.
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will be accurate or complete.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right that cannot be excluded under the Australian Consumer Law or other applicable law.
To the maximum extent permitted by law, Minesite and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from or related to the Services.
Our total liability for any claim arising from or related to the Services is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the claim, or (b) AUD $100, except where liability cannot be limited under applicable law.
You will indemnify and hold harmless Minesite from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms, except to the extent caused by our breach or negligence.
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the Services ends, but sections that by nature should survive (including payment obligations, disclaimers, liability limits, and indemnity) will survive.
Terminating your account does not automatically cancel App Store subscriptions.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be notified by email or in-app notice. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-law principles. You submit to the non-exclusive jurisdiction of the courts of Western Australia, except where mandatory consumer protections require otherwise.
